These Terms of Use (“Terms”) govern your use of the Cajun Countertops website (the “Site”) and the services we provide. By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Site and services.

1. Use of the Site

  • Eligibility: By using this Site, you represent and warrant that you are at least 18 years old or accessing the Site under the supervision of a parent or legal guardian.

  • License to Use Submissions: By submitting any material (comments, suggestions, ideas, etc.) to the Site, you grant Cajun Countertops a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, distribute, and display such submissions.

4. Liability and Disclaimers

  • Disclaimer of Warranties: The Site and all content, services, and materials provided through it are provided “as is” without warranties of any kind, either express or implied. Cajun Countertops makes no warranties or representations regarding the accuracy, completeness, or reliability of any content on the Site.
  • Limitation of Liability: Cajun Countertops will not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Site, services, or materials available through the Site. This includes any loss or damage arising from delays, failures, or disruptions in the Site’s operation or transmission.
  • Force Majeure: Cajun Countertops is not responsible for delays or failures to perform under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, power outages, strikes, or acts of terrorism.

5. Service Terms for Projects

  • Scope of Services: Cajun Countertops provides custom concrete countertop design, fabrication, and installation services. The scope of each project will be defined in a separate service agreement specific to that project.
  • Project Completion and Delays: We strive to complete each project within the agreed-upon timeline. However, factors such as weather conditions, unforeseen site issues, or supply chain disruptions may cause delays. Cajun Countertops is not liable for delays beyond our control, but we will communicate any delays promptly.
  • Site Access: You agree to provide our team with reasonable access to your property to perform the agreed-upon services. Any additional costs due to lack of access or other site-related issues will be your responsibility.
  • Safety: Cajun Countertops follows industry-standard safety practices during all phases of the project. However, we are not responsible for any damages caused by existing structural deficiencies on the property.
  • Materials and Subcontractors: Cajun Countertops reserves the right to use subcontractors for certain aspects of the project, such as plumbing or electrical work, and may source materials from third-party suppliers.

6. Liability and Insurance for Projects

  • Liability for Damages: Cajun Countertops carries insurance to cover accidental damages caused during the performance of our services. However, we are not responsible for pre-existing conditions on the site, defects in the property, or issues arising from customer-provided materials.
  • Insurance Coverage: We maintain appropriate liability insurance for all on-site work. Customers are encouraged to maintain homeowner’s or commercial property insurance to protect against any incidental damages outside of Cajun Countertops’ control.

7. Payments and Refunds

  • Deposits: A deposit is required to commence work on a project, and the deposit amount will be outlined in the service agreement.
  • Payment Terms: Payments are due in accordance with the milestones established in the service agreement. Failure to make timely payments may result in work stoppages or project delays.
  • Refunds: Custom concrete countertop projects are non-refundable due to the specialized nature of the product. However, we will work with you to ensure satisfaction within the scope of the project agreement.

8. Third-Party Links

The Site may contain links to third-party websites. These links are provided for your convenience, and Cajun Countertops does not endorse or control the content of these websites. You acknowledge and agree that Cajun Countertops is not responsible for the availability or content of these external sites.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes arising from the use of the Site or services provided by Cajun Countertops shall be resolved in the state or federal courts located in Shreveport, Louisiana.

10. Changes to the Terms

Cajun Countertops reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or services constitutes acceptance of the modified Terms.

11. Termination

Cajun Countertops reserves the right to terminate or suspend access to the Site or services at our discretion, without notice, for any conduct that violates these Terms or is harmful to our interests or other users.
